A firestop question from someone who doesn't venture much into that space - if we are using a firestop sealant around through-wall pipe and duct penetrations, and there is exposed structure in the room where everything is being painted black, can the sealant also be painted black?

Check with the manufacturer AND THE AHJ. If painted may not be able to visually verify the inclusion of the fire stopping material.

dont you have to have "rated wall stenciling" to show that the wall is rated and what the rating is ? surely not painting over that yes ?

It depends on the listing of the compound. There are some out there that are listed as compatible with latex paint.

Talk with your AHJ and check the product cut-sheet as others have pointed out. Also, consider that as a compromise if the AHJ and manufacturer allow painting the sealant, you can put some signage up by the penetration with the system number and a note that the AHJ allowed it to be painted.

As an inspector I would say, if you do go and paint it, perhaps type out and leave documentation of the fire stop material used, and where it was used, in a plastic envelope that is affixed to something nearby that an inspector an locate and see. I always appreciate when a thoughtful engineer leaves some details of whatever it is I am trying to figure out.
