Mandate for Old Standpipe Meeting Old Code?

Where is (or is there) a code or standard provision for an existing/old standpipe system that mandates that the standpipe system must follow the codes (and edition) in which it was originally installed?

The term "grandfathering" does not appear in the codes that I use in my work.

It is a industry practice that as long as the system can still perform as originally designed and as long as it applicable to the current conditions, we leave it as is.

Yes, the equipment at the time of installation must be compliant with the building code enforceable at the time of permitting.

If it was installed incorrectly it should be corrected to the permitting requirements.

If this is a system over 30 years old then a conversation with the AHJ is advisable to determine the requirements that should be enforced and the practical costs vs life safety needs. If its a small item like changing the height of all hose valves by 3'' I'm sure a variance could be issued. If its an issue of not having all the required stairs with standpipes you might have a harder argument against upgrading the building.

If a code/standard changed, it's because of new information/data from fire loss experience, fire tests, and public input from qualified professionals. Legally the AHJ can't retroactively apply a newer code/standard unless the AHJ determines that the existing situation presents an unacceptable degree of risk (chapter 1 in the NFPA codes/standards), but as a fire protection professional you are expected to educate your client on how they can provide a reasonable degree of protection which often times isn't leaving outdated systems in service if there is an opportunity to upgrade it. Saving your client money can also mean putting lives and property at risk.

So my issue would be NFPA 25 states that it is not the inspector's job to re-certify the system. It was certified at one point by an AHJ
Is the standpipe functional? If so, it passes inspection.

If not, it gets red tagged and must be serviced. Without further information, why is the issue being brought forth?

An inspection is not a recertification. The systems are usually certified at the buildings acceptance.
There are municipalities that require bring the building up to code if a high portion is being renovated like 60% or so.
If there is something glaringly wrong, bring it to the owners attention in the notes portion of the inspection and he can sort it out.

Former fire marshal (37 years); was on state fire code committee for several years. Also worked for the state fire marshal and was in charge of state fire code adoption for over 20 years. Here is my take on this.

Construction-related standards - such as NFPA 13, 14, 72, NEC, plumbing code, etc.) - are rarely retroactive. If they were, many owners would have to re-wire their buildings every time a newer edition of the NEC was adopted, rework the means of egress every time a new building or fire code takes effect, or re-plumb their buildings every time the plumbing code was updated.

The International Fire Code (IFC) handles this in Section 102.1:
102.1 Construction and design provisions. The construction and design provisions of this code shall apply to:
1. Structures, facilities and conditions arising after the adoption of this code.
2. Existing structures, facilities and conditions not legally in existence at the time of adoption of this code.
3. Existing structures, facilities and conditions where required in Chapter 11.
4. Existing structures, facilities and conditions that, in the opinion of the fire code official, constitute a distinct hazard to life or property.

Retroactive provision enforcement can take place for the following:
* When specifically required for existing buildings in IFC Chapter 11.
* When the fire code official rules that the condition is a "distinct hazard". Note: in my opinion, that is a pretty high bar (i.e. people will die or be seriously injured, or the building will burn to the ground in a devastating manner). It is not intended to be applicable simply because the fire code official feels that they want it.
* Maintenance, housekeeping, and operational provisions are retroactive.

The IFC Commentary states the following about the application of the distinct hazard provision:
"The fire code official should be prepared to demonstrate, based on evidence or case histories that would be defensible in a court of law, that a distinct hazard exists. This would be especially true where enforcement would result in substantial expense to the property owner or when a building has remained in compliance with the edition of the code under which it was originally constructed."

The inverse of IFC 102.1, item 2 above is that the condition can remain if legally in existence and does not represent a distinct hazard (item 4)

Refer to the city adopted code for IFC 2018 refer to section 901.6 or Appendix I, reminder appendixes should be adopted to be enforced

If the IEBC is adopted or used e.g. IEBC 2018 refer to repair definition chapter 2 the reconstruction, replacement or renewal of any part of an existing building for the purpose of its maintenance or to correct damage and section 403 for reference

A similar issue is for fire sprinkler Tenant Improvements.
Many AHJ's specify that the seismic and other requirements
IN THE AREA BEING REVISED be brought up to code. Some also ask for Air Vents, and or Excess Pressure Reliefs....

These should be included in their local Adopting Ordinance, or a local handout, so contractors and designers should check before bidding.
