Every Sleeping Room Need An Escape Window?

The International Residential Code (IRC 2021) Section 310.1 states: "Basements, habitable attics and every sleeping room shall have not less than one operable emergency escape and rescue opening. Where basements contain one or more sleeping rooms, an emergency escape and rescue opening shall be required in each sleeping room. Emergency escape and rescue openings shall open directly into a public way, or to a yard or court having a minimum width of 36 inches (914 mm) that opens to a public way."

My building code official is reading this as sleeping rooms in attics and basements need an escape window. I am reading "Basements, habitable attics and every sleeping room " as a list of 3 without the use of an Oxford comma.

Any sleeping room needs an escape window, right?

They all need escape openings or 2nd way out. Regardless of presence of sleeping room need two ways out in habitable attic or basement; stairs and a rescue opening or window.

Sprinklers can modify this

Yes, every sleeping room requires an operable window for escape.

Also if a basement or attic has a room with a sofa you really need that 2nd way out from that space as it can and likely will be used for sleeping occasionally. There are arrangements that can be made where two rooms can share an egress window with the requirement that the path to the escape window / door is always available to both rooms. Look into the explanatory in the codes for a better description.

I refer to NFPA 101 Life Safety Code, specifically in Chapter 24: One- and Two-Family Dwellings. The requirements are very similar:

The key provisions appear in NFPA 101 (Life Safety Code), Chapter 24, Section 24.2.2.3 (Secondary Means of Escape).
• It requires a secondary means of escape (typically an operable window or door) from every sleeping room and from living areas in one- and two-family dwellings.
• For basements, if they contain habitable space or sleeping rooms, an emergency escape opening is generally needed.
• The opening must be operable from the inside without tools or keys, with minimum dimensions very close to the IRC:
• Net clear opening area: 5.7 sq ft (for new construction; sometimes 5.0 sq ft for existing).
• Minimum width: 20 inches.
• Minimum height: 24 inches.
• Maximum sill height above the floor: 44 inches.
• The window/door must allow direct access to the exterior, and it must be reachable (e.g., within about 20 ft of grade level or directly accessible to fire department apparatus).

IRC-2021 Section 310.1 establishes three distinct conditions where at least (1) operable Emergency Escape and Rescue Opening (EERO) is required :

Basements: Every basement must have at least (1) EERO.

Habitable Attics: Every habitable attic must have at least (1) EERO.

Every Sleeping Room: Every room used for sleeping purposes, regardless of what story it is on, must have its own individual EERO.
